No, they are not the same, though they are fundamentally linked. Live Scan is the digital fingerprinting process that collects and submits your fingerprints electronically. These fingerprints are then used as part of a background check, which is the broader review of your criminal history and other relevant records by agencies like the California Department of Justice (DOJ) or the FBI.

In short: Live Scan captures the fingerprints; the background check is the investigation that uses those fingerprints along with other data. Both are necessary steps for many job and licensing requirements.

Live Scan fingerprinting is a crucial requirement across various professional and personal contexts, primarily used for conducting thorough background checks to maintain safety, security, and integrity. Organizations, licensing boards, and government agencies mandate Live Scan to verify identities and assess an individual's suitability for specific roles or responsibilities.

Here are the primary situations where Live Scan is typically required:

1. Employment Background Checks:Many industries, particularly those involving sensitive roles like healthcare, education, law enforcement, finance, and government, require Live Scan. This process helps employers confirm an applicant's identity and screen for any criminal history that could impact eligibility for a position.
2. Professional Licensing:If you are pursuing a professional license—for example, as a real estate agent, contractor, teacher, or medical professional—Live Scan is frequently a mandatory component of the application. It ensures you meet the necessary regulatory standards and maintains the integrity of your profession.
3. Volunteer Positions:To safeguard vulnerable populations such as children, the elderly, or individuals with disabilities, many organizations require volunteers to undergo fingerprint-based background checks. Live Scan ensures a safe environment for these groups.
4. Government Clearances:For roles that necessitate a government security clearance, Live Scan fingerprinting is a standard part of the process. It's used to meticulously check for any disqualifying criminal records or past issues that could pose a security risk.
5. Certifications and Permits:Certain certifications and permits, including those for firearms, notary public services, as well as processes for adoptions and foster care, often stipulate Live Scan as a requirement to establish eligibility and ensure public trust.
6. Legal and Regulatory Compliance:In numerous instances, state and federal laws or industry-specific regulations mandate fingerprint-based background checks for individuals in particular roles or sectors. Live Scan helps ensure compliance with these statutes, which are designed to protect the public interest.

In summary: Live Scan provides a reliable and accurate method for background verification. It empowers agencies, employers, and licensing bodies to confirm identity and review criminal history, ensuring individuals meet the necessary criteria for various jobs, licenses, or volunteer opportunities.
